< Statement of Purpose and Main Contents >
Under the current law, the Minister of Agriculture, Food and Rural Affairs or the Minister of Oceans and Fisheries may certify organic food, etc. to foster the organic food industry and protect consumers.
The law further stipulates that any person who advertises a product that has not been certified as organic food as if it were certified, or who advertises a certified product in a manner inconsistent with the certified content, shall be subject to imprisonment for up to three years or a fine of up to 30 million won.
However, although the law already includes punitive provisions covering not only the use of official “certification marks” but also the use of terms such as “organic,” “pesticide-free,” or “eco-friendly” in a way that could mislead consumers into believing the product is certified, judicial authorities have occasionally dismissed cases where the literal terms “certification mark” or “certified” were not explicitly used. This has created limitations on enforcement activities carried out by the National Agricultural Products Quality Management Service (NAQS).
Therefore, this amendment aims to explicitly stipulate that persons who (i) advertise uncertified products as certified products, (ii) advertise certified products inconsistently with the certified content, or (iii) repeatedly (two or more times) engage in misleading advertisements that could cause products to be mistaken as certified, shall be subject to enforcement measures. This clarification is intended to ensure the smooth execution of monitoring and enforcement activities related to eco-friendly certification. (Proposed Article 30(1), etc.)
